Alpha Family Resale, Inc (“Alpha Family Resale,” “we,” “us,” or “our”), a 501(c)(3) non-profit organization, operates a mobile messaging program (the “Program”) subject to these Mobile Messaging Terms and Conditions (these “Terms”). The Program and our collection and use of your information are also subject to our Privacy Policy.
By opting in, enrolling, signing up, providing your mobile number, or otherwise agreeing to participate in the Program, you accept and agree to these Terms and our Privacy Policy.
1. Program Description
When you opt in, you consent to receive recurring automated text messages (SMS and/or MMS), which may include promotional and informational messages about sales, special offers, store updates, events, promotions, abandoned cart reminders (if applicable), and other information related to Alpha Family Resale’s resale store and programs. Messages may be sent using an automatic telephone dialing system or other automated technology. Consent is not a condition of any purchase or donation.
2. Message Frequency
Message frequency varies and may change. You may receive up to 4 messages per month. We reserve the right to adjust the number or frequency of messages.
3. Costs
Message and data rates may apply. Check with your mobile carrier for details about your plan. Carriers are not liable for delayed or undelivered messages.
4. Opt-In
By providing your mobile phone number and opting in (e.g., via website form, keyword text, in-store, or other method), you voluntarily agree to receive messages at that number (or any number you designate), even if it is on a Do Not Call list. You represent that you are the owner or authorized user of the mobile number and are at least 18 years old.
5. Opt-Out / Cancellation
You may cancel the Program and stop receiving messages at any time by replying STOP, CANCEL, UNSUBSCRIBE, QUIT, END, or OPT-OUT to any message. After you send the opt-out keyword, you will receive a confirmation message, and we will stop sending messages to that number (except possibly one final confirmation). You may re-enroll at any time by opting in again through the original method. We will honor opt-out requests made by any reasonable means as required by law.

7. Supported Carriers
The Program is supported by major US carriers including (but not limited to) AT&T, Verizon, T-Mobile, and others. Not all carriers may participate, and participation may change. Carriers are not liable for delayed or undelivered messages.
8. Changes to Terms
We may modify these Terms at any time. Continued participation after changes constitutes acceptance of the updated Terms. Material changes will be noted by updating the “Last Updated” date or by other notice.
9. Disclaimer of Warranties; Limitation of Liability
The Program is provided “as is.” To the fullest extent permitted by law, we disclaim all warranties. We, our service providers, and carriers are not liable for any delays, delivery failures, errors, or damages arising from the Program or these Terms. Our total liability shall not exceed the amount you paid us (if any) in the 12 months preceding the claim, or $100, whichever is greater (to the extent permitted by law).
10. Dispute Resolution; Governing Law
These Terms are governed by the laws of the State of Indiana, without regard to conflict of law principles. Venue for any court proceedings shall be in Lake County, Indiana.
11. Miscellaneous
If any provision is found unenforceable, the remaining provisions remain in effect. These Terms constitute the entire agreement regarding the Program. Our failure to enforce any right is not a waiver.

Text messaging originator opt-in data and consent will not be shared with third parties except as necessary to provide the messaging services.
5. Opt-Out and Your Choices
You may opt out of SMS messages at any time by replying STOP (or other keywords listed in our Terms). You can also contact us directly. Opting out of texts does not affect other communications or your ability to use our services.
For other privacy rights (access, correction, deletion, etc.), contact us as described below. Residents of certain states (e.g., California under CCPA/CPRA) may have additional rights; contact us to exercise them. We will not discriminate against you for exercising rights.
6. Data Security and Retention
We implement reasonable administrative, technical, and physical safeguards to protect your information. No method of transmission or storage is 100% secure.
We retain information only as long as necessary for the purposes described, to maintain consent records, or as required by law.
7. Children’s Privacy
